Image license terms
These terms cover every photograph licensed from lucaskstudios.com. They're written to be read, not skimmed past. If something isn't clear, email hello@lucaskstudios.com before you buy.
01Who this agreement is between
“We” and “us” means Lucas K Studios, LLC, a Wisconsin limited liability company. “You” means the person or organization named in the Licensed to field at checkout (the licensee).
The license belongs to the licensee, not to whoever paid. If you're buying for a client or employer, put their name in Licensed to. By checking the box at checkout, you confirm you're allowed to accept these terms for them.
Each license covers one photograph, one licensee and one tier. Your receipt and the license PDF we email you record all three.
02What every license gives you
When your payment goes through, we grant the licensee a license to use the photograph for the uses its tier allows (section 4). The license is:
- Non-exclusive. We can license the same photograph to others and keep using it ourselves.
- Perpetual. It doesn't expire. Work you publish under it can stay up, and you can keep using the photograph for the same purpose.
- Worldwide.
- Non-transferable. The licensee can't sell, assign or sublicense it to someone else. If your organization is acquired or renamed, the license moves with the business. Just let us know.
You may:
- Crop, resize, color-correct and add text or graphics over the photograph.
- Share the file with people working for you (a designer, printer, web developer or agency), but only to produce your own materials. They can't keep or reuse it.
- Keep backup copies of the file.
03What no license allows
Unless we agree otherwise in writing, you may not:
- Resell or redistribute the file itself: on stock sites, in templates, theme or asset packs, as a free download, or as an NFT or other digital collectible.
- Put it on products for sale: prints, posters, calendars, apparel, mugs, packaging or anything where the photograph is the main reason someone buys. Prints are sold through this site; product use needs an Advertising & products quote.
- Use it in a logo, trademark or brand mark.
- Use it to train, fine-tune or test any AI or machine-learning model, or add it to a dataset for that purpose.
- Imply we endorse you, your product or a cause, or attribute the photograph to anyone else.
- Use it in a way that's unlawful, defamatory, pornographic or hateful, or that shows any recognizable person in a way they'd reasonably object to.
- Edit it so it misleads. Adding or removing objects to change what a place looked like, then presenting it as real, isn't allowed. Ordinary editing (section 2) is fine.
People and property. We don't provide model or property releases. Some photographs show buildings, landmarks or people. If your use needs a release, getting it is your responsibility. That applies especially to commercial uses.
04The tiers
Your tier sets what the photograph can be used for. If a use fits more than one tier, the narrower tier applies. If you're unsure, ask before you buy.
| Tier | Covers | Doesn't cover |
|---|---|---|
| Web & social | Promoting the licensee's own business or organization online: website, social posts, newsletters, blog, online portfolio, presentations | Paid ads; print |
| Print & marketing | Everything in Web & social, plus printed materials the licensee produces for itself: brochures, reports, menus, flyers, signage, wall graphics and murals in its own spaces | Paid ads; products for sale |
| Editorial | Illustrating a news story, article, book, documentary or educational material, in print or online. Credit required (section 5) | Promotion, marketing or advertising of any kind, including sponsored content |
| Advertising & products | Paid ads, billboards, broadcast, packaging and merchandise | Quote only. Covered by a separate written agreement, not these terms |
Paid advertising means any placement you pay to run: social or search ads, boosted posts, print or outdoor ads, sponsored articles, broadcast or streaming spots. Posting on your own accounts without paying to promote the post is Web & social.
05Credit
Editorial use must credit the photograph where credits normally appear: next to it, in the caption or in a credits list. Use Photo: Lucas K Studios.
For other tiers credit is appreciated but not required. A tag on social posts (@lucaskstudios) is always welcome.
06Delivery
After payment you'll see a download page and get an email with your license PDF. The download link is good for 7 days and works more than once in that window. Save the file somewhere safe. If the link expires before you've downloaded it, email us and we'll send a new one.
The license PDF is your proof of license. Keep it with the file.
07Payment, tax and refunds
Prices are in US dollars. Sales tax is added at checkout where it applies. Payment is handled by Stripe; we never see your card details.
- Before you download: if you change your mind, email us within 7 days of purchase for a full refund.
- After you download: the sale is final, because a downloaded file can't be returned.
- Always fixed: a duplicate purchase made by mistake is refunded, and a file that's damaged or not what was described is replaced, or refunded if we can't replace it.
A refunded license ends on the date of the refund. Delete the file and stop using it.
08Ownership
You're buying a license, not the photograph. Lucas K Studios, LLC keeps the copyright and all rights not granted here.
09If the license ends
The license ends automatically if you break these terms or reverse the payment (a chargeback, for example). If that happens you must stop using the photograph and delete your copies. Printed materials already distributed don't have to be recalled. If you break the terms by accident, tell us; we'd rather fix it with you.
10Our promises and their limits
We promise that we own the rights to license the photograph for the uses in its tier. Beyond that, the photograph is provided as is.
To the extent the law allows, our total liability for any claim about a license is limited to the price you paid for it. Neither of us is liable to the other for indirect or consequential losses, such as lost profits.
11Changes and the law that applies
We may update these terms. The version in force on the date of your purchase is the one that applies to your license, and its date is on your license PDF.
These terms are governed by the laws of the State of Wisconsin. Any dispute goes to the state or federal courts serving Dane County, Wisconsin.
